Terms of Use

Open Road Ace is a pacing tool for sanctioned open-road racing. Read this carefully before installing or using the app.

1. Sanctioned use only

Open Road Ace is intended exclusively for use during officially-sanctioned, closed-course or law-enforcement-escorted time-speed-distance racing events authorized by an organizing body such as the Silver State Classic Challenge (SSCC), the Sports Car Club of America (SCCA), the Sandhills Open Road Challenge organizers, or an equivalent recognized sanctioning body. The app is not designed for, and must not be used to encourage or assist, exceeding posted speed limits on public roads outside of such events.

2. You assume all risk

Open-road racing is inherently dangerous. By using Open Road Ace, you acknowledge and agree that:

  • You are solely responsible for your driving conduct, vehicle condition, route choices, and decisions on the road at all times.
  • You will obey all applicable laws, traffic regulations, and instructions from law-enforcement officers and event officials.
  • You will not use the app's pacing output as justification for violating the speed limit or any other traffic law.
  • You assume all risk of property damage, personal injury, citation, prosecution, or death arising from your use of the app, your participation in any racing event, or your operation of a motor vehicle.

3. The app is informational, not authoritative

Open Road Ace displays GPS-derived pacing data based on signals from your device and any paired GPS receivers. This data may be inaccurate, delayed, unavailable, or wrong for reasons including (but not limited to) GPS signal loss, hardware failure, software defect, environmental interference, or incorrect course geometry. Never rely on the app's output as a substitute for your own judgment, your vehicle's instruments, or instructions from event officials.

4. No legal authorization is implied

Use of Open Road Ace does not authorize, sanction, license, or excuse any violation of traffic laws, speed limits, or vehicle regulations. Speed limits posted on public roads remain in force at all times except during properly authorized events with an active road closure or law-enforcement escort.

5. No warranties

OPEN ROAD ACE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER (KyrosWorks LLC) BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, OPEN ROAD ACE — including, without limitation, damages for property damage, personal injury, traffic citations, criminal prosecution, vehicle damage, lost profits, or death — even if the developer has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the developer's liability shall be limited to the maximum extent permitted by law and shall not exceed the purchase price you paid for the app.

7. Indemnification

You agree to defend, indemnify, and hold harmless the developer (KyrosWorks LLC) from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of Open Road Ace or your violation of these Terms.

8. Intended audience

Open Road Ace is intended for adult, properly-licensed drivers participating in sanctioned events. It is not intended for use by minors, by drivers operating without a valid license, or by anyone operating a vehicle in violation of applicable laws.

9. Changes to these Terms

The developer may update these Terms from time to time. Material changes will be reflected in the “Effective” date above and, where appropriate, surfaced inside the app. Continued use of the app after changes constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Harris County, Texas.
